A Dangerous Precedent

According to the Fifth Amendment of the US Constitution, Americans are never to be deprived of life, liberty, or property without due process of law. The Constitution is not some aspirational statement of values, allowing exceptions when convenient, but rather, it is the law of the land. It is the basis of our Republic and our principal bulwark against tyranny.

Last week’s assassination of two American citizens, Anwar al-Awlaki and Samir Khan, is an outrage and a criminal act carried out by the President and his administration. If the law protecting us against government-sanctioned assassination can be voided when there is a “really bad American”, is there any meaning left to the rule of law in the United States? If, as we learned last week, a secret government committee, not subject to congressional oversight or judicial review, can now target certain Americans for assassination, under what moral authority do we presume to lecture the rest of the world about protecting human rights? Didn’t we just bomb Libya into oblivion under the auspices of protecting the civilians from being targeted by their government? Timothy McVeigh was certainly a threat, as were Nidal Hassan and Jared Lee Loughner. They killed people in front of many witnesses. They took up arms against their government in a literal way, yet were still afforded trials. These constitutional protections are in place because our Founders realized it is a very serious matter to deprive any individual of life or liberty. Our outrage against even the obviously guilty is not worth the sacrifice of the rule of law. Al-Awlaki has been outspoken against the United States and we are told he encouraged violence against Americans. We do not know that he actually committed any acts of violence. Ironically, he was once invited to the Pentagon as part of an outreach to moderate Muslims after 9/11. As the US attacks against Muslims in the Middle East and Central Asia expanded, it is said that he became more fervent and radical in his opposition to US foreign policy.

Many cheer this killing because they believe that in a time of war, due process is not necessary – not even for citizens, and especially not for those overseas. However, there has been no formal declaration of war and certainly not one against Yemen. The post-9/11 authorization for force would not have covered these two Americans because no one is claiming they had any connection to that attack. Al-Awlaki was on a kill list compiled by a secret panel within President Obama’s National Security Council and Justice Department. How many more Americans citizens are on that list? They won’t tell us. What are the criteria? They won’t tell us. Where is the evidence? They won’t tell us.

Al-Awlaki’s father tried desperately to get the administration to at least allow his son to have legal representation to challenge the “kill” order. He was denied. Rather than give him his day in court, the administration, behind closed doors, served as prosecutor, judge, jury, and executioner.The most worrisome aspect of this is that any new powers this administration accrues will serve as precedents for future administrations. Even those who completely trust this administration must understand that if this usurpation of power and denial of due process is allowed to stand, these powers will remain to be expanded on by the next administration and then the next. Will you trust them? History shows that once a population gives up its rights, they are not easily won back. Beware.

 

Decriminalize the Average Man

If you reside in America and it is dinnertime, you have almost certainly broken the law. In his book Three Felonies a Day, civil-liberties lawyer Harvey Silverglate estimates that the average person unknowingly breaks at least three federal criminal laws every day. This toll does not count an avalanche of other laws — for example misdemeanors or civil violations such as disobeying a civil contempt order — all of which confront average people at every turn.

An article in the Economist (July 22, 2010) entitled “Too many laws, too many prisoners” states,

Between 2.3m and 2.4m Americans are behind bars, roughly one in every 100 adults. If those on parole or probation are included, one adult in 31 is under “correctional” supervision. As a proportion of its total population, America incarcerates five times more people than Britain, nine times more than Germany and 12 times more than Japan.

By contrast, in 1970, less than one in 400 Americans was incarcerated. Why has the prison population more than quadrupled over a few decades? Why are you, as an average person and daily felon, more vulnerable to arrest than at any other time?

There is a simple answer but no single explanation as to how the situation arose or why it continues to accelerate out of control. The answer: a constant flood of new and broadly interpreted laws are criminalizing entire categories of daily life while, at the same time, the standards required for arrest and conviction have been severely diluted. The result is that far too many people are arrested and imprisoned for acts that should not be viewed as criminal at all or should receive minimal punishment.

In some cases, the violated laws are so obscure, vague, or complicated in language that even the police are ignorant of them. In other cases, outright innocence is not sufficient to escape the brutality of detention.

The Obamas: A book with juicy details!

There is a new book that just came out called “The Obamas” by Jodi Kantor and it offers some very interesting inside stories into the Obama White House since 2009.

And what kind of book would it be, if it didn’t include rather juicy stories as well!

Kantor’s book describes the President and his family’s three years of freeloading thus far as historic. And how historic it has become. At the height of a troubled economy, President Obama, after campaigning relentlessly on “Hope and Change” bull-crap, thought it would be fun to throw a Halloween party in 2009 based on the theme of Tim Burton’s “Alice in Wonderland” which starred Johnny Depp. So much so that the White House actually invited both Burton and Depp to the party itself completed with Tim Burton’s usual style of weird and Gothic atmosphere. This particular Halloween party was kept on low-profile according to Kantor because the administration feared public backlash as tens of millions of Americans were struggling (and continue to struggle) with the burdens of the recession. Perhaps a more curious question that lingers is how much tax money was spent on this 2009 Halloween party?

But then again, President Obama has lived in an “Alice in Wonderland” environment since he took office.

Some of Kantor’s other scriptures provided in the book include one particular incident involving a rather tense and verbal argument between former White House Spokes-hole Robert Gibbs and Obama’s Senior White House Adviser Valerie Jarrett. According to Kantor’s description of events depicted in the book, this particular incident gave light into the rather hostile working environment at the White House, describing Gibbs as “going off” after Ms. Jarrett told him about how First Lady Michelle Obama was angry at Mr. Gibbs for apparently a statement he made as to how Mrs. Obama described living at the White House as “hell” and seemed to imply that Mrs. Obama was nothing more than an “angry black woman.”

According to the book, Gibbs began shouting profanities as Ms. Jarrett saying:

“F-this, that’s not right… where’s this coming from?” Gibbs continued, accusing Ms. Jarrett that she “didn’t know what the f-you’re talking about” and preceded to say of Mrs. Obama, “Then f-her, too!” and stormed out of the room.

Politico.com released an article today with Mr. Gibbs and Ms. Jarrett “pushing back” against Kantor’s book, implying that the story was exaggerated, but neither denied that the incident happened. Either way you look at it Mr. Gibbs was a pathetic Press Secretary.

There were also stories involving heated clashes between Michelle Obama and former White House Chief of Staff Rahm Emanuel who is now the Mafia chief of Chicago with Mrs. Obama holding reservations about Emanuel from the start and his tenure of trying to perhaps even “undermine” her husband’s job as President.

Kantor also paints a clear picture of President Obama and his thoughts on the pathetic do-nothing Congress, labeling them as a bunch of “self-interested dullards” while Mrs. Obama thinks voters don’t understand the magnitude of her husband’s many accomplishments.

Oh yeah, like we really need any more proof of the Obama’s accomplishments thus far. Nothing has worked and his policies have all proven to have become absolute complete failures.

Perhaps the most provoking answer of all came from Michelle Obama herself. While admitting that she has not read Kantor’s book, she told CBS News anchor Gayle King:

“I never read any of these books… I love this job. It has been a privilege from day one. I guess it’s just more interesting to imagine this conflicted situation here… A strong woman … That’s the kind of image … that I’m some kind of angry black woman.”

But she does love the job as First Lady? I’m sure she does. What First Lady doesn’t appreciate the fact that she and her husband get to abuse tens of millions of dollars of tax money while the average middle class American is struggling every day, so they can fly all over the world and vacation in Colorado during the winters, Hawaii during the summers, taking their friends to Spain and fly down to Africa for a Safari adventure and eat deep fried fat cakes?

Yes, the Obama White House has been filled with some juicy stories over the last three years. And hopefully this year, it will be there last!
